OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to possible crushing hazards when operating a powered industrial truck without benefit of a seat belt.    a)  In the Shop and yard: the employer did not ensure or enforce the use of seat belts while employees operated a powered industrial truck.
