OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to severe burns and/or death from chemical release/spills:     TANK FARM: The nitric acid blending/mixing tank, that was containing DI water and being filled with 67% nitric acid from the main bulk tank utilizing powered pump was not equipped with appropriate safety devices and equipment, such as (but not limited to) automatic shut off device, over filling warning and alarm devices during the power filling process to prevent the "blending/mixing tank" from being over filled, causing chemical spills/release.        On/or about January 28, 2014 at approximately 12:15 PM, the above "blending/mixing tank" was over filled during the above task without an attendant, and a nitric acid release/spill occured. The employees could have sustained severe chemical burns from the incident.
