Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to carbon monoxide: (a) On or about February 5, 2014, for an employee fatally exposed to carbon monoxide levels of 5273 ppm for approximately 25 minutes where adequate carbon monoxide detection equipment was not used at or near 1004 Highway 1806 West in Watford City, North Dakota.
