29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification:    a) On or about 2/10/14, at the Boulevard Mall, Space # 545 under renovation for a "Justice" store, 742 Niagara Falls Blvd.,Amherst, NY: A metal 2-receptacle, 120 volt-ac outlet box attached to a flexible metalic conduit was laying on the concrete floor in the building. A Relocatable Power Tap (strip) was plugged into a receptacle in that box and through a series of extension cords supplied power to a Ridgid Abrasive Wheel Cut-Off Saw. The use of the unmounted box laying on the floor is prohibited by the National Electric Code, and the Relocatable Power Tap (strip) is not listed for use on construction sites.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:     a) On or about 2/10/14, at the Boulevard Mall, Space # 545 under renovation for a "Justice" store, 742 Niagara Falls Blvd.,Amherst, NY: Employee used a Ridgid Abrasive Wheel Cut-Off Saw, Model # CM14500, to cut metal studs. The Cut-Off saw was connected to 120 volt-ac power via a series of two extension cords, the first of which was Relocatable Power Tap (strip) plugged into a receptacle of a 2-receptacle outlet box laying on the floor. The plug on the power cord of the saw lacked a ground prong.      NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee was not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:    a) On or about 2/10 14, at the Boulevard Mall, Space # 545 under renovation for a "Justice" store, 742 Niagara Falls Blvd.,Amherst, NY: Employee was exposed to a potential fall from the elevated platform of a JLG Scissors Lift while pulling wires in the ceiling. The employee was standing on the midrail of the lift platform and additionally, the midchain on the entry end of the platform was not fastened.     NO ABATEMENT CERTIFICATION REQUIRED
