OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushed-by hazards while using a defective Rotary brand swing air jack to lift vehicles.  Main Shop Area, Bay #14, 300 Beaver Valley Mall, Monaca, PA 15061:  Observed on or about February 10, 2014, the secondary lift (Rotary brand swing air jack) on a Rotary brand two post lift was exhibiting signs of erratic operation.  The November 2013 monthly inspection report for this automotive lift reads "Secondary jacks seem week and not wanting to lift vehicles."  The lift was not immediately taken out of service and repaired by a qualified person.  Employees using the secondary lift were exposed to crushed-by hazards.

29 CFR 1910.36(d)(1):  A required exit(s), way of approach thereto, and/or way of travel from the exit into the street or open space, was not continuously maintained free of all obstructions or impediments to full instant use in the case of fire or other emergency:      a) Shop area, 300 Beaver Valley Mall, Monaca, PA 15061:  Observed on or about February 10, 2014, an emergency exit door leading from the shop area to the outside was locked with a padlock.  Employees working in the shop area were exposed to fire and smoke inhalation hazards.
