29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): A) Faurecia Exhaust Systems, Inc., located at 5255 Telegraph Rd., Toledo, OH 43612: On or about February 10, 2014, the employer did not remove powered industrial vehicle Toyota (Model 8FGU25, Serial # 10661) from use based on mechanical defect such as, but not limited to, defective strobe light. Employees were exposed to struck-by and caught-in-between hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields: A) Faurecia Exhaust Systems, Inc., located at 5255 Telegraph Rd., Toledo, OH 43612: On or about February 10, 2014, the employer did not ensure that the welding areas in the facility were enclosed with noncombustible or flameproof screens or shields, exposing employees, adjacent to the welding area, to eye injuries from the welding rays. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
