OSH ACT of 1970 Section (5)(a)(1): On or about 11 February 2014, and at times prior thereto, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not wearing the seat belts equipped on the LPG forklifts, exposing the employees to struck by or crushing hazards.

29 CFR 1910.178(q)(7): Industrial trucks were not examined, at least daily or before each shift if used on a round-the clock basis, before being placed into service.  On or about 11 February 2014, and at times prior thereto, forklift operators were allowed to operate the two LPG forklifts onsite without daily inspections being performed, exposing the operators and those nearby to a struck by or crushing hazard from the forklifts.

On or about 11 February 2014, and at times prior thereto, an employee performing wood working activities was using compressed air for cleaning purposes in his work area that was not reduced to 30 p.s.i, exposing the employee to the hazard of being struck by flying objects or debris.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment.     On or about 11 February 2014, and at times prior thereto, a breaker panel located on the south side wall of the front warehouse had the access door open revealing an open breaker slot roughly 5/8ths of an inch wide that was energized, exposing employees who access the panel to an electrical hazard of approximately 220 volts.
