OSH ACT of 1970 Section (5)(a)(1): On or about 11 February 2014, and at times prior thereto, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were not wearing the seat belts equipped on the LPG forklifts, exposing the employees to struck by or crushing hazards.

29 CFR 1910.303(b)(7)(i): Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment. On or about 11 February 2014, and at times prior thereto, a breaker panel located on the south side wall of the front warehouse had the access door open revealing an open breaker slot roughly 5/8ths of an inch wide that was energized, exposing employees who access the panel to an electrical hazard of approximately 220 volts.
