29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:     Humbug Marina, in the maintenance shop, a Caterpillar forklift, Model V40B, S/N 31M1364 had modification which affected the capacity and safe operation of the forklift.  The forklift modification allows for a trailer hitch attachment to be affixed to the tips of the forks which was used to move a move a 21 foot boat and trailer from the maintenance shop.  Additionally, the forks had been modified with holes to retain the trailer hitch attachment.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  29 CFR 1910.178(l)(2)(ii) is applicable to shipyard employment by 29 CFR 1915.120 that incorporates the general industry requirements.    Humbug Marina, In the Maintenance shop, employees required to operator forklifts were not provided training on the safe operation of forklifts that included formal instruction, practical training and an evaluation of the operators performance in the workplace.
