29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) Colonial Glen Apartments, Harrisburg, Pennsylvania, in front of Building Marked 4975/4985 Hamilton Drive - An employee worked in an excavation while the excavator operator on the top side of the excavation removed soil from the excavation.  The employee working in the excavation did not wear a hard hat, exposing this employee to a struck-by hazard from a falling object or load, on or about February 12, 2014.    No abatement certification or documentation required.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    (a) Colonial Glen Apartments, Harrisburg, Pennsylvania, in front of Building Marked 4975/4985 Hamilton Drive - The foreman, who served as the competent person operated the excavator to dig the excavation and directed a pipelayer to enter the excavation to work.  The foreman/competent person did not protect this employee from a cave-in hazard in that the foreman/competent person correctly classified the soil as Type C but did not slope the sides of the excavation 1.5 horizontal :1 vertical (34 degrees) or use other cave-in protection, and the excavation had depths ranging from 5 feet 5 inches to 9 feet deep, on or about February 12, 2014.    No abatement certification or documentation required.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a) Colonial Glen Apartments, Harrisburg, Pennsylvania, in front of Building Marked 4975/4985 Hamilton Drive - An employee worked in the excavation, which ranged from 5 feet 5 inches deep to 9 feet deep, dug in Type C soil, to install a new sewer lateral.  This excavation did not have any protective system, exposing the employer to a cave-in hazard, on or about February 12, 2014.  No abatement certification or documentation required.
