29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: Located along various perimeter exterior stud wall top plate areas of the residential structure employees were observed without conventional or alternative fall protection performing truss erection activities who were not trained or knowledgeable of the procedures or regulations to minimize those hazards.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Located along front and rear areas of the new residential structure employees were observed performing perimeter exterior stud wall top plate truss erection associated operations without conventional or alternative fall protection systems or methods and were exposed to fall potentials in excess of 20. Tower Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 554078, Citation Number 1, Item Number 2, Issued on 08/22/12, with respect to a workplace Located at 2651 Creek Wood Cir. Moraine, OH 45050. This citation became final on 9/19/12. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
