29 CFR 1926.102(a)(1):   Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents.   On or about February 12, 2014, on the roof, the employer did not ensure employees using electric cutter saws and pneumatic nail guns were protected by the use of protective eyewear.  The employees were actively using the electric cutter saws and pneumatic nail guns on the day of this inspection while cutting and installing roof materials on the building.  This condition exposed the employee to serious eye injuries.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.  Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  On or about February 12, 2014, at a job site located at 1401 Kanis Park Road, Little Rock, AR, on a low-sloped roof, the employer did not ensure employees were protected from falling by use of fall protection systems, while they were constructing dormers on the roof. This practice exposed the employees to fall hazards of 26 feet to the ground below.

29 CFR 1926.502(h)(1)(v): The safety monitor had other responsibilities which could take the monitor's attention from the monitoring function:  On or about February 12, 2014, on the roof, the employer did not ensure that the foreman/safety monitor was not distracted from his monitoring activities.    Instance a:  The Foreman/Safety Monitor was framing a roof dormer from the inside of the structure while standing 5 feet above the roof surface on a 2 x 4 inch piece of scrap lumber, while another employee was on the opposite side of the roof constructing another roof dormer.  This created a condition which exposed the employee to unprotected falls of 26 feet to ground below.    Instance b: The Foreman/Safety Monitor was framing a roof dormer from the inside of the structure while standing 5 feet above the roof surface on a 2 x 4 inch piece of scrap lumber, while another employee was greater than 6 feet away from sawcutting pieces of lumber on the roof.  This created a condition which exposed the employee to unprotected falls of 26 feet to ground below.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  On or about February 12, 2014, on the fascia board of the main roof, the employer did not ensure that employees working from a stepladder were properly using the ladder for the purpose in which it was designed. Employees were framing roof dormers, while using a stepladder in the closed position without its metal spreader or locking device engaged to hold the front and back sections in an open position. This condition exposed employees to the hazard of stumbling and falling from the stepladder during mounting and dismounting.
