29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      a) On or about February 12, 2014 and at times prior, Bob McGrath Construction LLC as the controlling employer, did not ensure that employees of Whitley Homes, Inc. were protected from fall hazards of more than 6 feet from the unprotected sides of the lodge and cabin. The employees were not provided with a fall protection system.

29 CFR 1926.851(b): All stairs, passageways, ladders and incidental equipment thereto, which are covered by this section, were not periodically inspected and maintained in a clean and safe condition:      a) On or about February 12, 2014 and at times prior, Bob McGrath Construction LLC as the controlling employer, did not ensure that employees of Whitley Homes, Inc. were protected from slipping hazards from the slippery floor covered with water. Water was dripping from the second level where melting snow was located.
