29 CFR 1910.1200(e)(1): The employer had not developed, implemented, or maintained a written hazard communication program which at least describes how the criteria in 29 CFR 1910.1200(f), (g) and (h) will be met: (a) Mezzanine, Intramural Building Penn State University - Employees mixed two parts of the Koster VAP I 200 epoxy moisture vapor reduction system and spread it onto the concrete floor surface with squeeges. The Material Safety Data Sheet indicated that the product is corrosive and exposure to part B of the product may cause moderate to severe eye injury and is severely irritating to the skin causing burns, inhaled vapors may be irritating to the respiratory system. The company had not developed, implemented nor maintained a written Hazard Communication Program on or about February 10, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv): The employer did not produce a hazard communication program that included an explanation of the labels received on shipped containers and the workplace labeling system used by their employer and the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) Mezzanine, Intramural Building Penn State University - The employer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively on or about February 10, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
