29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part. Construction site: On or about February 10, 2014, one employee was working on the scaffold without any form of fall protection. This condition exposed the employee to a fall greater than 10-feet to the ground below. The employer did not provide Safety & Health Programs to enable employees to recognize the hazards. Hazards associated with scaffolds are such as but not limited to fall and/or struck-by hazards.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: Construction site: On or about February 10, 2014, one employee on the scaffold at the rear of the building was working without a guard rail system or a personal fall arrest system. This condition exposed the employees to a fall hazard greater than 10-feet to the ground below.
