29 CFR 1903.19(d)(1): The employer did not submit to the Agency documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a) The employer failed to provide documentation and certification for abatement of citation 1 item 1a in which the employer did not ensure that each container of hazardous chemicals was labeled or marked with the product identifier, signal word, hazard statement(s), pictogram(s), precautionary statements(s) and name, address and telephone number of the chemical manufacturer, importer, or other responsible party. Condition observed on or about 2/18/14 and 3/11/14.  b) The employer failed to provide documentation and certification for abatement of citation 1 item 1b in which employees were not trained on hazardous chemicals. Condition observed on or about 2/18/14 and 3/11/14.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier, signal word, hazard statement(s), pictogram(s), precautionary statement(s) and name, address, and telephone number of the chemical manufacturer, importer, or other responsible party.  a)  Red Metal Box in Truck Wash Area, 327 Slapes Corner Road, Carneys Point, NJ 08069: On or about February 18, 2014 and March 11, 2014, the red metal container was not labeled.  b)  Plastic Carboy in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069:  On or about February 18, 2014 and March 11, 2014, the 255 gallon plastic carboy was not labeled.  c)  Plastic 55 gallon drum in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069,  On or about March 11, 2014 a plastic 55 gallon drum of fluorescent yellow green liquid was not labeled.  d)  Plastic 1 gallon jug in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069.  On or about March 11, 2014 a plastic 1 gallon jug of a fluorescent yellow green liquid was not labeled.  e)  Plastic container labeled Fuze Iced Tea in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069.  On or about March 11, 2014 a plastic bottle labeled to contain a consumable iced tea contained motor oil and was not labeled as such.  f)   Plastic, yellow, five gallon container in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069.  On or about March 11, 2014 a yellow, plastic 5 gallon container with the molded words "Diesel Fuel" on its exterior, contained motor oil and was not labeled as such.  g)   Metal, five gallon pail in Truck Wash Area, 327 Slapes Corner Road, Carney's Point, NJ 08069.  On or about March 11, 2014 an unlabeled metal pail contained an oil like liquid and was not labeled as such.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a)  Truck Wash Area, 327 Slapes Corner Road, Carneys Point, NJ 08069: On or about February 18, 2014 and March 11, 2014, the employer did nor ensure that each employee was trained in the hazards associated with chemicals in their work area.   NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
