29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.   The employer does not ensure that eye or face protective equipment is used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.     a.       This violation was observed on or about February 18, 2014, on the east side of the building where employees were exposed to a struck-by hazard when removing dried cement from brick without safety glasses.       b.      This violation was observed on or about February 18, 2014, on the east side of the building where employees were exposed to a struck-by  hazard when cutting brick in half using a stationary masonry saw without safety glasses or a face shield.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are using eye and face protective equipment when machines or operations present potential eye and face injury from physical, chemicals or radiation agents.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.       The employer does not ensure that scaffold platforms more than 2 feet above or below a point of access is provided with a proper means of access. This violation was observed on or about February 18, 2014, at the work-site where employees cutting out window openings in the side of a building climbed the scaffold frame of a tubular welded framed scaffold to gain access to the work level.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure scaffold platforms more than 2 feet above or below a point of access is provided with a proper means of access.

29 CFR 1910.1200(g)(1): The employer did not have a material safety data sheet for each hazardous chemical which they used: (Construction Reference: 1926.59)   The employer did not have a material safety data sheet for each hazardous chemical he used.  This violation was observed on or about February 18, 2014, on the east side of the building where employees were exposed to hazardous chemicals such as but not limited to gasoline and masonry cement when cutting out window openings in a building.            Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a material safety data sheet is provided for each hazardous chemical used at the workplace.
