Section 5(a)(1) of the Occupational Safety and heatlh Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from moving traffic: On February 19, 2014, Eddie's Landscaping, L.L.C, employees worked in and near the travel way of Robinwood Drive without wearing high visibility safety apparel. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: On or about February 19, 2014, employees loading a wood chipper did not wear eye or face protection, thereby exposing employees to the hazards associated with eye and face injuries. There is no abatement certification or documentation required for this item.
