The washing facilities designated for employees was placed out of service and human waste was left without removal for approximately two (2) months.

29 CFR 1910.141(d)(2)(ii): Lavatories were not provided with hot and cold, or tepid running water: At the jobsite located 1205 South 5th Street, Saint Charles, Missouri the employer did not provide running water in the wash facilities for employees. Employees were required to go to the Dunkin Donuts next door approximately 80 feet from the facility or drive to a gas station or home to use washing facilities for several weeks.

29 CFR 1910.23(a)(9): Every floor hole into which persons cannot accidentally walk (on account of fixed machinery, equipment, or walls) shall be protected by a cover that leaves no openings more than 1 inch wide. The cover shall be securely held in place to prevent tools or materials from falling through. In the storage area adjacent to the wash facilities a floor hole measuring approximately (3.5 inches in depth X 23.5 inches in width X 39 inches in length) was left uncovered and unprotected.
