OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazard from a scissor lift. (a) Southside of the Rotunda - On or about February 13, 2013 one employee was exposed to a fall hazard and tip over hazards when climbing the guardrail system of a Genie GS-2646 Scissor Lift to get into the platform.

29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems. (a) Southside of the Rotunda - On or about February 13, 2013 one employee was exposed to a fall hazard when seating on a steel rafter when marking the area for welding. Employee was not protected from falling 22 feet 10 inches to a lower level by the use of personal fall arrest system, safety net system or guardrail system.
