Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of crushing: On or about 02/20/2014, an employee was exposed to crushing hazards while operating a Caterpillar 320C L Excavator to spread top soil in the islands of the parking lot without utilizing the seat belt provided by the manufacturer. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to, ensuring that operator(s) of the Caterpillar 320C L Excavator have read and understand the safety and operation instructions in the manual prior to operation, and utilize the seat belt provided during operation, as specified by the Caterpillar 320C Excavator Operation and Maintenance Manual.
