29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59) a) Child Development Ctr., Bldg. 1983, Naval Base Guam - Noted on or about 2/11/14 and at times prior thereto, the employer did not maintain Material Safety Data Sheets (MSDS's or SDS's) for chemical products currently being used in the workplace. Employees use Sherwin Williams A-100 Exterior acrylic paint, BASF caulk, and KemTek muriatic acid thereby exposing employees to the hazards listed on the MSDS's

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a) Child Development Ctr. Bldg. 1983, Naval Base Guam - Noted on or about 2/11/14 and at times prior thereto, the employer failed to train potentially exposed employees on the new label elements (i.e. pictograms and signal words) and the new SDS formation by 12/2/13 as required by the revised Hazard Communication Standard. Employees use hazardous chemicals such as but not limited to Sherman Williams exterior latex paints, KemTek muriatic acid, and BASF caulk at the work site.

29 CFR 1926.50(g): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use: a) Child Development Ctr. Bldg. 1983, Naval Base Guam - Noted on or about 2/11/14 and at times prior thereto, the eyewash station was located approximately 150 feet away from the work site where employees use chemical products such as KemTek muriatic acid, paints, and thinners. The eyewash needs to be situated closer to where the actual work is being done.
