29 CFR 1926.150(c)(1)(viii): Portable fire extinguishers were not inspected periodically in accordance with maintenance and use of portable fire extinguishers, N.F.P.A. No. 10A-1970:   The employer does not ensure that portable fire extinguisher are inspected periodically in accordance with maintenance and use of portable fire extinguisher, N. F. P. A. No. 10A-1970:      a.       This violation was observed on or about February 19, 2014 on the north side of the senior high building, where employees were exposed to a fire hazard in that the Badger fire extinguisher [Model 5MB6H] had not undergone an annual maintenance check.      b.      This violation was observed on or about February 19, 2014 on the north side of the senior high building, where employees were exposed to a fire hazard in that the portable fire extinguisher mounted on the mixer was covered by hardened masonry cement and had not undergone an annual maintenance check.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all portable fire extinguishers are periodically inspected.

29 CFR 1910.1200(f)(9): The employer did not ensure that labels or other forms of warning were legible, in English, and prominently displayed on the container, or readily available in the work area throughout each work shift: (Construction Reference: 1926.59)   The employer does not ensure that labels or other forms of warning were legible, in English, and prominently displayed on the container, or readily available in the work area throughout each work shift. This violation was observed on or about February 19, 2014 at the Senior High School Building where employees performing masonry work used a brick cleaner from a container whose labeling was not legible or prominently displayed on the container.               Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that labels or other forms of warning were legible, in English, and prominently displayed on containers of hazardous chemicals throughout the work shift.
