29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).   The employer does not protect employees from falling when working 6 feet or more above lower levels. This violation was observed on or about February 21, 2014, at the construction site where employees were exposed to an 18 ft. fall hazard when performing roofing activities on a residential structure without a fall protection system.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees engaged in residential construction activities 6 feet or more above lower levels are protected from falling.

29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigged support that will not deflect and a grasping device was not provided to assist employees in mounting and dismounting the ladder.  The employer does not ensure that when the ladder's length doesn't allow the side rails to extend 3 feet above the step off point that the ladder is secured at the top to a rigid support to prevent deflection and a grasping device is provided. was used by employees is extended 3 feet above the upper landing surface. This violation was observed on or about February 22, 2014, at the construction site where employees were exposed to a 10 foot fall hazard while using an extension ladder that could not be extended 3 feet above the step off point without the ladder being secured at the top to a rigid support and a grasping device to assist in mounting and dismounting.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that extension ladder that can not be extended 3 feet above the step off point are secured at the top to a rigid support and a grasping device is provided to assist in mounting and dismounting.
