OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible dust explosion, deflagration, or other fire hazards while working at or near inadequate dust collection systems. a) Weigh out/ Spice Room - On or about, and at times prior to February 20, 2014, and at times prior to, two Delta Model AP400 Type 1 Single Stage Dust Collectors that were not designed to collect combustible sugar dust were used to collect sugar dust, exposing employees to injuries resulting from a dust deflagration or other fire hazards. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.

29 CFR 1910.303(b)(2): Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling: a) Battery Charging Area Warehouse: On or about, and at times prior to February 20, 2014, employees were allowed to use battery chargers that were not installed and used per manufacturer's safe operating procedures. The battery chargers were attached to wooden pallets (combustible material), thus exposing the employees to life safety hazards such as fire and smoke inhalation. b) Spice Room/Weigh Out Room - On or about, and at times prior to February 20, 2014, a relocatable power tap (power strip) that was mounted on the leg of a workbench was being used to provide additional receptacles to a heater and a scale. ABATEMENT CERTIFICATION IS REQUIRED.
