On or about February 20, 2014, and times prior thereto, potentially hazardous energy sources of the Bidwell Boom Truss Automatic Roller Finisher were not locked-out to prevent accidental start-up of the augers and/or paving rollers when employees performed maintenance, including cleaning of the rollers and augers.

29 CFR 1926.20(b)(1): the employer did not initiate and maintain programs as necessary to comply with this part: a) worksite at Rt. 949 and Clear Creek Park Rd. near Sigel, PA. On or about February 20, 2014, and times prior thereto, a lockout/tagout program had not been initiated to identify hazardous energy sources and to prevent inadvertent operation of machines/equipment during servicing and maintenance operations. Personnel performed servicing and maintenance on machines/equipment that included but were not limited to the Bidwell Boom Truss Automatic Roller Finisher. Servicing and maintenance on the Bidwell Boom Truss Automatic Roller Finisher, included cleaning, of the equipment. Employees were exposed to caught-by hazards from the concrete finishing machine when cleaning wet cement off the augers and paving rollers.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) worksite at Route 949 and Clear Creek Park Rd. near Sigel, PA. On or about February 20, 2014, employees were potentially exposed to struck-by, caught-between, and fall hazards from riding on a load suspended by the forks of a skid steer. Employees rode on a load being hauled by a Bob-Cat skid steer to act as counterweight and to secure pallets, garbage, and debris.
