29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.    (a) Top plate, new residential construction located at 307 Highland Falls, Hiram, GA 30141: Employees operating pneumatic Hitachi (Model NR83A) Framing Nail Guns which fire 3-inch plastic collated nails were not protected from eye injuries as these tools were operated without safety glasses or other eye protection.

29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:    (a) Rear side, new residential construction located at 307 Highland Falls, Hiram, GA 30141: Employee was exposed to severe laceration and amputation hazards while using a Makita (Model 5007F) 7-1/4-inch Circular Saw with Diablo Carbide tipped blade without a guard covering the rotating blade below the shoe. Employees used a wood shim to prevent the lower guard from retracting after a cut was performed.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     (a) Front top plate, new residential construction located at 370 Highland Falls, Hiram, GA 30141: Employee was exposed to falls while engaged in residential framing activities while working from the top plate at heights of approximately 9-feet, 1-inch without a fall protection system in place.    (b) Rear top plate, new residential construction located at 370 Highland Falls, Hiram, GA 30141: Employee was exposed to falls while installing 1/2-inch OSB plywood sheathing from the top plate located approximately 8-feet, 5-inches without a fall protection system in place.
