29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  On or about February 5, 2014, at the above addressed jobsite, the employer did not develop a hazard communication program for the jobsite to specify the location access of safety data sheets, the labeling system to be used onsite, how multi employer worksite would be addressed, and information regarding employee training, for employees who supervise, inspect, and oversee work tasks being completed by workers using chemicals such as, but not limited to, stucco and adhesive, that contain hazardous chemicals such as, but not limited to, silica, Portland cement, and methyl acetate.

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:  On or about February 5, 2014, at the above addressed jobsite, the employer did not provide adequate  information regarding the hazards of chemicals, according to the Globally Harmonized System of Classification and Labeling of Chemicals with pictograms or representations as a part of the new SDS and label format to employees who perform work duties in proximity to workers using chemical products that contain hazardous chemicals such as but not limited to, Portland cement, silica, and methyl acetate.
