29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i). Jobsite: Stonewater Creek, Millsboro, DE- An employee was inside an excavation while installing a main sewer line on a residential construction site. The excavation was measured at approximately 200 feet long, 14 feet wide, and 9 feet deep, and was lacking proper cave-in protection. The soil was classified as type C, because of water accumulation. Observed on or about 2/20/2014. Abatement Note: Ensure protective system is provided such as sloping, benching, appropriate for soil type, or a trench box or other type of protective system is used prior to authorizing an employee inside a trench 5 feet deep or greater or a trench under 5 feet deep with adverse condition and a potential for cave in.
