29 CFR 1926.652(c)(4): Support systems, shield systems, and other protective systems that did not utilize Option 1, Option 2, or Option 3 were not approved by a registered professional engineer. a) The employer did not ensure that support systems, shield systems, and other protective systems that did not utilize Option 1, Option 2, or Option 3 were approved by a registered professional engineer. This violation occurred on or about February 20, 2014 when the employer modified the approved installation of a GME Trench Shield (Model MH10DW NKE) using timber at the spreader ends placing a surcharge from earth and timber directly on the spreaders. The use of timber in that fashion was not approved by the manufacturer and did not have the approval of a registered professional engineer.

29 CFR 1926.652(c)(2)(iii): Manufacturer's specifications, recommendations, and limitations, and manufacturer's approval to deviate from the specifications, recommendations, and limitations were not in written form at the jobsite during construction of the protective system. a) The employer did not ensure that the manufacturers specifications, recommendations, and limitations were in written form at the jobsite during construction of the protective system. This violation occurred on or about February 20, 2014 when the employer installed a GME Trench Shield (Model MH10DW NKE) at the Tulane University Football Stadium jobsite without maintaining a copy of the manufacturer's tabulated data at the jobsite.
