OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:   Employees performing maintenance and housekeeping tasks in the boot pit were exposed to struck-by injuries in that the manlift did not have a gate to prevent employees from being under the manlift.      Among other methods, one feasible and acceptable method to correct this hazard is:  Enclose the landing area with a 7 foot door with controls of the manlift outside of the enclosed area in accordance with ASME A17.1-2010, American Society of Mechanical Engineers, in Safety Code for Elevators and Escalators, Paragraph 2.11.1.1, Hoistway Landing Entrances, which requires that "all elevator hoistway landing openings shall be provided with entrances that shall guard the full height and width of the openings. Entrances shall be at least 2030 mm(80 in.) in height and 800 mm (31.5 in.) in width.

29 CFR 1910.23(a)(2): Ladderway floor opening(s) or platform(s) were not guarded by a standard railing with standard toeboard(s) on all exposed sides (except at the entrance to opening) with passage through the railing either provided with a swinging gate or so offset that a person could walk directly into the opening:  Employees performing maintenance and inspections on the bucket elevator leg were exposed to fall hazards of 8 feet 6 inches from the elevated platform to the roof of the headhouse in that the ladder opening was not protected.

The drive pulleys for the drag conveyor were not guarded on the back side.
