29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): On or about February 24, 2014, sub-contractors performing demolition operations using tools such as, but not limited to saws, hammers and crow bars were not notified of asbestos containing pipe insulation located high in the ceiling above temporary wall prior to the removal of the temporary wall. ABATEMENT DOCUMENTATION REQUIRED

29 CFR 1926.1101(k)(4): Employer who discovered asbestos containing material and/or presumed asbestos containing material on a worksite did not convey information concerning the presence, location and quantity of such newly discovered asbestos containing material and/or presumed asbestos containing material to the owner and to other employer of employees working at the worksite within 24 hours of discovery: Durham, NC VA Hospital: On or about February 24, 2014, the employer did not report the discovery of asbestos containing material to the building owner and other employers while employees were performing demolition operations on a temporary wall.
