29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface was not used: a) For the jobsite at 3300 Bonita Beach Rd., Bonita Springs, FL 33716, as observed on or about 02/25/2014, a ladder for safe access and exiting of scaffolding was not present. As the controlling contractor for the stucco work, Karr Brothers Drywall, Inc. did not ensure that a ladder was present for the scaffolding, and employees of Karr Brothers Drywall, Inc. were also exposed to hazards due to the missing ladder for the scaffolding and were observed to climb the scaffolding frame and cross braces since there was no access ladder.

29 CFR 1926.451(e)(9)(i): The employer did not provide safe means of access for each employee erecting or dismantling a scaffold: a) At the jobsite at 3300 Beach Rd., Bonita Springs, FL 34134, as observed on or about 02/25/2014, employees engaged in dismantling scaffolding were not provided with a safe means of ladder access. Employees were observed to be removing planking from scafdfolding with its structure intact, and had to climb the scaffold frame and cross braces since there was no ladder to access the level they were working on.

29 CFR 1926.451(e)(9)(iv): Cross braces on tubular welded frame scaffolds were used as a means of access or egress. a) For the jobsite at 3300 Bonita Beach Rd., Bonita Springs, FL 33716, as observed on or about 02/25/2014, Karr Brothers Drywall, Inc. was hired to perfom stucco work and was the controlling contractor for stucco work. Employees of Karr Brothers Drywall Inc. and another subcontractor were exposed to fall hazards from accessing the scafolding without a ladder. Employees were observed climbing the cross braces and the scaffolding frame of the tubular welded scaffolding that was in place on site.
