On or about February 27, 2014, frequent and regular inspections such as probing the utility pole #27W7663 located at Stubbs Road in South Lebanon, Ohio below ground was not conducted by a competent person prior to employees climbing the utility pole to remove the wires.

29 CFR 1926.950(b)(1): Existing conditions shall be determined before starting work, by an inspection or a test. Such conditions shall include, but not be limited to, energized lines and equipment, conditions of poles, and the location of circuits and equipment, including power and communication lines, CATV and fire alarm circuits. On or about February 27, 2014, the condition of the wooden utility pole #27W7663 located at Stubbs Road in South Lebanon, Ohio was not sufficiently determined prior to starting work by an inspection procedure and/or test adequate to account for among other possible conditions, extreme cold weather condition where such inspections and test may be insufficient to reveal the need for guying or bracing of poles, prior to employees climbing the utility pole to remove the wires,"

29 CFR 1926.955(a)(2): Prior to climbing poles, ladders, scaffolds, or other elevated structures, an inspection shall be made to determine that the structures are capable of sustaining the additional or unbalanced stresses to which they will be subjected. On or about February 27, 2014, prior to two employees climbing the same utility pole #27W7663 located at Stubbs Road in South Lebanon, Ohio no inspection was made to ensure that the pole was capable of sustaining the weight of both employees.
