Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling load: At this work site, the employer did not use the appropriate lifting device and did not ensure the proper device maintenance, application and inspection for lifting operations: a. The Renfroe Model FR Clamp, designed for flat plate surface lifting, was attached to the curved end of pipes for lifting operations. b. The Renfroe Model FR Clamp, designed for vertical lifting applications, was used for lifting tank building material from horizontal to vertical positions. c. The Renfroe Model FR clamp was not adequately maintained and inspected for the lifting operations performed at this site.
