29 CFR 1910.178(q)(6): Powered industrial trucks were altered so that the relative positions of the various parts were different from what they were when originally received from the manufacturer, by the addition of extra parts not provided by the manufacturer, or by the elimination of any parts without the manufacturer's approval:           On the Toyota Forklift, Model 8FGU15, Serial Number 33071       a)     The electronic sensor beneath the seat (Operator Presence Sensing System (OPSS) was not mounted in its proper position, was broken and bypassed.  The sensor is intended to prevent the forklift from moving when an employee leaves the seat while the forklift is in gear.                                                                        b)    The damaged mast guard had been removed from the front fork area.  The guard is designed to protect employees from loads placed upon the forks.
