29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet (1.8m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:      a) Employees were exposed to 50 ft fall hazard working without fall protection at the outer edges of the top deck (5th floor) during concrete construction; employees were installing plywood deck floor and stringers at the outer edges. Employees wore harnesses but did not have lifelines (or retractible lifelines).       Location: 81 Fleet Place, Brooklyn, N.Y; construction worksite. 29 CFR 1926.503(c):  The employer did not ensure that: When the employer has reason to believe that any affected employee who has already been trained in fall protection requirements of 1926.503(a) does not have the understanding and skill required by paragraph (a) of this section the employer shall retrain each employee. Circumstances requiring retraining include but are not limited to situations where there are, (1) changes in the workplace, (2) changes in types of fall protection systems or equipment, (3) employees understanding or skill level indicates the need for retraining:  Employees were not provied with additional training on fall protection procedures to use when working at the top deck during concrete hirise building construction.   a) Employees were exposed to 50 ft fall hazard when installing plywood decking, formwork, and guardrails at the outer edges of the top deck.   b)  Column openings were left uncovered in the plywood top deck, awaiting column forms to be placed into the holes by crane. 15 employees were exposed to 10 ft fall hazard at (3) deck openings which were 3 to 4 ft wide. 29 CFR 1926.502(i)(3): All floor hole covers were not secured when installed so as to prevent accidental displacement by wind, equipment, or employees:    a) A plywood floor hole cover on the 3fl was not secured during concrete construction; employees can fall 10 feet or step into the 2 ft wide hole if the cover shifts. The cover was cut to the exact size as the floor hole so can collapse if displaced (shifted) one inch.    Location: 81 Fleet Place, Brooklyn, N.Y; construction worksite. 29 CFR 1926.701(b): All protruding reinforcement steel, onto and into which employees can fall, was not guarded to eliminate the hazard of impalement:      a)  Two steel tie rods (formwork tie rods) were unprotected, sticking out 15 inches horizontally at eye level in the stairwell just below the top deck.  Several rebar were uncapped, sticking up two feet on the top deck near the stairwell.  Employees were exposed to impalement hazard/ eye injury. (3) Provides procedures/ measures to protect from the chemical/ product hazards, such as: work practices (avoidance/ limiting of exposure); use of personal protective equipment (PPE) such as respirators, gloves, ventilation, fire extinguisher; emergency procedures.
