OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees working in the foundry were exposed to potential struck by and crushing hazards do to the inadvertent overloading of the spreader bars due to the lack of rated capacity marking on these lifting devices. a) Manufacturing Warehouse, on or February 27, 2014, the employer did not ensure the 25 foot spreader bar used to lift the Jersey barrier mold box was marked with its rated load capacity, exposing employees to struck-by and crushing injuries or death should the spreader bar become overloaded, causing it to fail and drop its 8,000 lb load.
