29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: On or around February 23, 2014 at the AN3 Unit of the Ascend Performance Materials facility in Alvin, Texas the employer did not provide employees working at the 31 D-5 Column with escape respirators to use for escape when the employees were working in an area subject to acrylonitrile and hydrogen cyanide.

29 CFR 1910.119(h)(3)(iv): The contract employer failed to assure that each contract employee followed the safety rules of the facility including the safe work practices required by paragraph (f)(4) of this section. On or around February 23, 2014 the contract employer did not ensure that each contract employee involved in removal of scaffolding from the 31 D-5 Column in the AN3 Unit of the Ascend Performance Materials facility in Alvin, Texas, followed the safe work practice of requiring each worker performing task at or above the pure deck to carry an escape respirators.
