On or about February 28, 2014, at the above addressed jobsite, an employee was carrying ice and water shield up a portable ladder used to access a roof, thereby exposing the employee to the hazards associated with falls.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a. On or about February 28, 2014, at the above addressed jobsite, an employee performing residential roofing operations approximately nine (9') feet above the ground was not protected from falls, thereby exposing the employee to fall hazards.
