29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  a) Lot #26 Duncan Street & 5th Ave, Christina Overlook, Wilmington, DE - Employee was observed working on a tubular welded scaffolding, approximately 12 feet above the ground, without adequate fall protection.  The scaffold was missing guardrails on the working platform.  The employee was washing the brick façade on a 2 1/2 story construction site.  The violation was observed on or about February 27, 2014.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms. Guardrail systems were not installed before the scaffold is released for use by employees other than erection/dismantling crews:  a) Lot #26 Duncan Street & 5th Ave, Christina Overlook, Wilmington, DE - An employee was observed working on scaffold that was two (2) bucks high, approximately 12 feet above the ground, without guardrails on all sides and ends.  The employee was not erecting/dismantling the scaffold.  This exposed the employee to fall hazards.  The violation was observed on or about February 27, 2014.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet above or below a point of access, portable ladders, hook-on ladders, attachable ladders for direct access from another scaffold, structure, personnel hoist, or similar surface were not used. Crossbraces were used as a means of access:   a) Lot #26 Duncan Street & 5th Ave, Cristina Overlook, Wilmington, DE - An employee was observed using the crossbraces to access the tubular welded scaffold, approximately 12 feet above the ground.  The employee climbed the crossbraces multiple times to conduct various duties at the 2 1/2 story residential construction site.  This exposed the employee to fall hazards.  The violation was observed on or about February 27, 2014.

29 CFR 1926.454(a): The employer did not have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:   a) Lot 26 Duncan Street & 5th Ave, Cristina Overlook, Wilmington, DE - Employees were required to work on scaffolding without being trained to recognize or eliminate the hazards associated with scaffolding and fall hazards.  The employee worked on scaffolding, approximately 12 feet above the ground, without fall protection (guardrails), at/near unguarded edges/sides, and climbed the crossbraces due to lack of an access ladder.  This exposed the employees to fall hazards.  The violation was observed on or about February 27, 2014.     ­Abatement Note        The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards.  Each employee must be trained by a competent person in the following:        1.  The nature of fall hazards in the work area;  2.  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be      used;   3.  The use and operation of guardrail systems, personal fall arrest systems, and other protection to be used;  4.  The proper use of the scaffold, proper handling of materials on the scaffold;  5.  The maximum intended load and load-carrying capacities of the scaffold;   6.  The standards contained in this subpart.        The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer did not ensure that each operator had successfully completed the training required (Construction reference - 29 CFR 1926.602(d):    a) Lot #26 Duncan Street & 5th Ave, Christina Overlook, Wilmington, DE - An employee was observed using an Pettibone all-terrain fork truck, Model: 10044, Serial: 3634 without being provided training to operate such equipment.  The employee used the equipment to move materials on the site, and to lift materials onto the scaffolding.  The violation was observed on or about February 27, 2014.
