29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  a) Hershey Creamery Company, 628 N. White Horse Pike, Hammonton, Warehouse:  Employees who worked with Car & Truck Touch Free Detergent, corrosive, were not required to wear protective eye equipment, occurred on or about 2/27/14.   b) Hershey Creamery Company, 628 N. White Horse Pike, Hammonton, Warehouse, Platform:  Employees who add water to the forklift battery were not required to wear protective eye equipment, occurred on or about 2/27/14.  NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

White Horse Pike, Hammonton, Warehouse:  An eye wash providing at least 15 minutes of a continuous flow was not provided for employees who were working with Car & Truck Touch Free Detergent, corrosive, observed on or about 2/27/14.  b) Hershey Creamery Company, 628 N. White Horse Pike, Hammonton, Warehouse, Platform:  An eye wash providing at least 15 minutes of a continuous flow was not provided for employee use for the employee who adds water to the forklift batteries, observed on or about 2/27/14.  NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter:  a)      Hershey Creamery Company, 628 N. White Horse Pike, Hammonton: The employer failed to provide training to employees expected to use a portable fire extinguisher in the event of an incipient stage fire, upon initial hiring and at least annually thereafter, occurred on or about 2/27/14.   BY THIS DATE THE EMPLOYER MUST EITHER CORRECT THE ALLEGED VIOLATION(S) OR IMPLEMENT A FIRE SAFETY POLICY, AS OUTLINED IN 29 CFR 1910.38 WHICH INCLUDES THE EVACUATION REQUIREMENTS OF 29 CFR 1910.157(b).   NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.

29 CFR 1910.23(d)(1)(iv): The employer did not ensure that stairs with four or more risers that were more than 44 inches wide but less than 88 inches wide had a stair railing on each open side and a handrail on each enclosed side.    a) Hershey Creamery Company, 628 N. White Horse Pike, Hammonton, Warehouse:  The stairs leading into the warehouse were not provided with an intermediate rail, observed on or about 2/27/14.  b) Hershey Creamery Company, 628 N. White Horse Pike, Hammonton, Warehouse, Back Platform:  The stairs leading to the platform bay area located in the back of warehouse were not provided with an intermediate rail , observed on or about 2/27/14.  ABATEMENT NOTE: Railings and handrails." Standard railings shall be provided on the open sides of all exposed stairways and stair platforms. Handrails shall be provided on at least one side of closed stairways preferably on the right side descending. Stair railings and handrails shall be installed in accordance with the provisions of 1910.23.  A standard railing shall consist of top rail, intermediate rail, and posts.  The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp.   NOTE:  THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
