29 CFR 1926.416(a)(3): Employer did not post or maintain proper warning signs at locations where the performance of the work could bring a person, tool, or machine into physical or electrical contact with an energized electrical power circuit:     The employer does not post and maintain proper warning signs where energized electrical power circuits exist.  This violation was observed on or about February 26, 2014, at the site where employees were exposed to an electrical hazard when working in close proximity to an electrical power circuit without the employer having posted warning signs where the power circuit exists.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that proper warning signs are posted where energized electrical power circuits exist.

29 CFR 1926.451(f)(6): Scaffolds were erected, used, dismantled, altered, or moved such that they, or any conductive material handled on them, could have come closer than the minimum distances established for specific voltages as set forth in the table in subparagraph (f)(6).    The employer does not ensure that when scaffolds are erected, used, dismantled, altered, or moved, that they do not come closer than 10 feet of energized power lines.  This violation occurred on or about February 26, 2014, at the construction site where employees were exposed to a 7200 V electrical hazard when employees were attempting to move the 45 foot scaffold leg without maintaining a distance of 10 feet from the energized power lines that were located 16 feet from the base of the scaffold leg.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that when scaffolds are erected, used, dismantled, altered, or moved, no parts come within 10 feet of energized power lines.

29 CFR 1926.451(f)(7): Scaffolds were not erected, moved, dismantled, or altered, by trained and experienced employees under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration:    The employer does not erect, move, dismantle, or alter scaffolds under the supervision and direction of a competent person.  This violation occurred on or about February 26, 2014, at the construction site where employees were exposed to an electrical hazard while moving a scaffold without being under the supervision and direction of a competent person.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that scaffolds are erected, moved, dismantled, and altered under the supervision of a competent person.

29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident:     The employer does not orally report fatalities within eight hours after the death of any employee from a work related incident.  This violation occurred on or about February 26, 2014 when the employer did not orally report the death of an employee from a work related incident within eight hours after the death of the employee.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all fatalities are orally reported to OSHA.
