OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from ladders that were used and/or modified contrary to manufacturers recommendations:    a) Warehouse - Hopper#1 - An employee utilized a Werner Aluminum 8-foot step ladder to access a platform that requires the  employee to step off the ladder and using a step on the ladder that is marked not to be used, therefore exposing the employee to an 8 foot fall hazard.   b) Warehouse - Hopper#2 - An employee utilized the top section of a Werner 24 foot aluminum extension ladder with the top two rungs removed, to access the platform to the hopper, therefore exposing the employee to an 8 foot fall hazard.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.   a)  Warehouse Hopper #1 - The working platform that surrounds the hopper was used to fill customer packages of pool chemicals.  The platform was not guarded by guardrails or toe boards, exposing employees to fall hazards of 8 feet 2 inches and struck by hazards from falling debris.  b)  Warehouse Hopper #2 - The working platform that surrounds the hopper was used to fill customer packages of pool chemicals.  The platform is not guarded by guardrails or toe boards, exposing employees to fall hazards of 8 feet 8 inches and struck by hazards from falling debris.  c)  Warehouse - The working area located on the second floor of the warehouse where employees fill the mechanical hoppers was not completely guarded by standard railings and toe boards, exposing employees to fall hazards of 9 feet, 3 inches and struck-by hazards from falling debris.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years:   a)  Warehouse - Two forklift operators had been trained, but the training was in June 2009. The employees had not received an evaluation since the training.
