OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees    Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by or caught between forklifts and other surfaces associated with the rollover of forklift trucks without the use of the operator restraint systems:       From the warehouse to a parking area outside the warehouse on or about March 4, 2014, the seatbelts were not worn while operating a Tusk forklift, casino number 3, model number 500 PG-16, serial number 212348A.

Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.:    (a) In the facilities shop on or about March 4, 2014, and at times prior thereto there was no guard for the chuck on a Dayton 17 inch Drill Press, model number 5Z146F. The drill press was used to drill holes in straps.    (b) In the facilities shop on or about March 4, 2014, and at times prior thereto there was no guard for the chuck on a Dayton 10 inch Drill Press, model number 4CY85. The drill press was used to drill holes in straps.

29 CFR 1910.213(c)(3): Each hand-fed circular ripsaw was not provided with nonkickback fingers or dogs so located as to oppose the thrust or tendency of the saw to pick up the material or to throw it back toward the operator:    In the facilities shop on or about March 4, 2014, and at times prior thereto, there were no non-kickback fingers or dogs for a Rigid table saw, model number TS3650, serial number P040541097. The saw was used to cut plywood and 2x8s along the grain.
