29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a powered industrial truck:  a. Where a forklift was used in plant operations, a training program, according to the specifics of the OSHA standard (1910.178(l)(2), (l)(3), (l)(4)), was not developed and implemented including "classroom" type training, demonstration, and evaluation, at least three year re-evaluations, and documentation of initial and three year evaluations.  (Note: any unique applications of operation need to be included in the training, such as reduced lifting capacities with fork extensions or lifts performed where other equipment might be used during the lift, such as crane or hoist use.  If prior training is used to satisfy the requirements of the standard, such as by a previous employer, a documented evaluation would be required.)
