For employees required to don a Moldex N95 when using a Bosch jackhammer and a Hitachi handheld chipper to break up concrete flooring. Sampling results indicated that employees have exposure to silica. The employer did not provide medical evaluations for those employees.

29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter:    (a) On or 03/07/2014, at 25 Bancroft Road, Poughkeepsie, NY, in a residential basement. For employees required to don a Moldex N95 when using a Bosch jackhammer and a Hitachi handheld chipper to break up concrete flooring. Sampling results indicated that employees have exposure to silica. The employer did not conduct a fit test on those employees.

29 CFR 1926.52(d)(1): In all cases where the sound levels exceeded the values shown in Table D-2 of 29 CFR 1926.52, a continuing, effective hearing conservation program was not administered:      (a) On or 03/07/2014, at 25 Bancroft Road, Poughkeepsie, NY, in a residential basement. For the employee that was using a Bosch jackhammer to break up concrete flooring for every job site. Sampling results indicated that employee was exposed to continuous noise at 159.3% of the permissible daily exposure limit (8 Hour Time Weighted Average Sound Level of 90dBA) or an equivalent sound level of approximately 93.3 dBA during the 269 minute sampling period on 3/17/14. Zero exposure was assumed for the unsampled time period. The employer did not implement the element of the hearing conservation program to include audiometric testing on an annual basis.
