29 CFR 1926.21(b)(2):     The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    Throughout the company and specifically at a worksite located at 101-103 Maple, Thedford, NE:  The employer failed to ensure that all employees were trained in the hazards of working in or excavations that are covered under Subpart P of 29 CFR 1926.  This training would include the steps necessary to recognize unsafe conditions as well as the actions necessary to mitigate those conditions.         Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.651(j)(2):     Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.    Worksite located at 101-103 Maple, Thedford, NE:  The spoil pile material was not kept a minimum of 2 feet from the edge of the excavation while employees were working within the trench.  The east side of the trench had locations where the spoil pile was directly adjacent to the trench wall.       Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: Worksite located at 101-103 Maple, Thedford, NE:  The employer did not perform an inspection of the excavation, to include mechanical testing of the soil, to determine if there were any factors that could have resulted in a cave in or other hazardous condition.  On February 17, 2014, the wall of a trench failed and partially engulfed an employee resulting in multiple pelvic fractures.    Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.  The abatement certification sheet is enclosed with the citations.

29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c).    Worksite located at 101-103 Maple, Thedford, NE:  The employer allowed employees to enter into an excavation which was not protected as required by the standard.  The excavation was approximately 7-8 feet in depth.         Abatement certification and abatement documentation is required for this violation.  The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful.
