29 CFR 1910.36(d)(1): Employees were not able to open an exit route door from the inside at all times without keys, tools, or special knowledge:  In the 20,000 square foot warehouse on or about March 5, 2014, and at times prior thereto, one exit door consisted of a 10 by 10 foot roll up door that led to the outside dock. Door leaves or grilles were were not operable from within the space without the use of any special knowledge or effort as the operator needed to know a chain hanging near the door could be used to manually raise the door or a button near the door would start an electric motor to raise the door.

29 CFR 1910.36(e)(1): A side-hinged door was not used to connect any room to an exit route:  In the 20,000 square foot warehouse on or about March 5, 2014, and at times prior thereto, one exit door consisted of a 10 by 10 foot roll up door that led to the outside dock. The other exit consisted of a side hinged door to an interior hallway about 150 feet from the rollup door.

29 CFR 1910.101(b): "Compressed gases." The in-plant handling, storage, and utilization of all compressed gases in cylinders, portable tanks, rail tankcars, or motor vehicle cargo tanks was not in accordance with Compressed Gas Association Pamphlet P-1-1965, which was incorporated by reference as specified in Sec. 1910.6:  Inside the warehouse next to the rollup door to the exterior dock on or about March 5, 2014, and at times prior thereto, a helium gas bottle was not stored in accordance with CGA Pamphlet P-1-1965 paragraph 3.3.8 which states in part: Protect cylinders from any object that will produce a cut or other abrasion in the surface of the metal. Do not store cylinders near elevators or gangways, or in locations where heavy moving objects may strike or fall on them. The helium gas bottle bottle was subject to being struck by forklifts that were driven through the rollup door opening. The helium was used to fill balloons for events at the casino and hotel.

29 CFR 1910.134(c)(2)(i): When the employer determined that any voluntary respirator use was permissible, the employer did not provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"):    Inside the wood shop on or about March 5, 2014, and at times prior thereto, employees were not provided with   the information contained in Appendix D of this section, and the employer allowed the employees to wear N95 respirators made by 3M Corporation. Employees employees wore the dust masks when they used power saws to cut fir wood, plywood, melomine particle board, and plexiglass.

29 CFR 1910.178(m)(5)(i): When a powered industrial truck was left unattended, load engaging means were not fully lowered, controls shall be neutralized, power shall be shut off, and brakes set:   On the warehouse dock on or about March 5, 2014, the tines were not lowered all the way to the floor on a Towmotor forklift, model number TGP25. The tines of the forklift were about 4 to 7 inches above the floor. The operator of the lift was not within 25 feet of the lift as he was inside the warehouse. The warehouse manager said the forklift was used to move pallets of decorative items for the hotel rooms.

29 CFR 1910.303(b)(2): Listed or labeled equipment was not installed and used in accordance with any instructions included in the listing or labeling:    Inside the wood shop on or about March 5, 2014, and at times prior thereto, a surge bar designed to power electronic equipment was used to power a 110 VAC Ryobi band saw. The saw was used to cut plexiglass and wood for tabletops.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about was introduced into their work area:  At the facility on or about March 5, 2014, and at times prior thereto, employees had not been made aware of the new Globally Harmonized System for dealing with hazardous chemicals in the workplace. Specifically, they were not aware that new warning labels on containers will have standardized pictograms to identify the hazards of the chemicals, and that material data sheets with a standardized format and warnings will replace the current material safety data sheets.
