On or about March 04, 2014, an employee was exposed to being struck-by a powered industrial truck that was driven up to the employee standing in front of a truck rolling chassis with brakes locked up.

29 CFR 1910.178(l)(2)(iii): Operators training and evaluation was not conducted by persons who have the knowledge, training, and experience to train powered industrial truck operators and evaluate their competence.    On or about March 06, 2014, and times prior thereto, employees who operate power industrial trucks were not trained by a person who had knowledge, training, and experience to train powered industrial truck operators.  This condition exposed employees to struck-by hazards from forklift operators not adequately trained.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.    On or about March 06, 2014, and at times prior thereto, employees who operate power industrial trucks received training that was not a combination of formal instruction, practical and evaluation of operator's performance in the workplace.  This condition exposed employees to struck-by hazards by power industrial trucks.

29 CFR 1910.178(l)(6): Certification. The employer did not certify that each operator had been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about March 06, 2014, and at times prior thereto, the employer did not include the practical power industrial truck training program and evaluation of employee's performance in the workplace certification.  Training not certified and instructed by a competent person exposed employees to struck-by and caught by safety hazards.
