29 CFR 1926.453(b)(2)(v):  A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    (a)Tally Ho Construction, Inc. at 732 Buckhorn Dr., Rifle, CO 81650:  On or before March 5, 2014 the employer did not ensure individuals working from the JLG, articulating boom aerial lift, was protected from falling from the basket by body harness with a lanyard attached to an anchorage point in the basket.   Abatement note to paragraph (b)(2)(v): As of January 1, 1998, Subpart M of this part [1926.502(d)] provides that body belts are not acceptable as part of a personal fall arrest system.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.  (a)Tally Ho Construction, Inc., at 732 Buckhorn Dr., Rifle, CO 81650:  On or before March 5, 2014 the employer did not ensure each employee engaged in construction activities installing "Simple Saver" on a walking/working surface having unprotected sides and/or edges were protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.  This condition exposed the employee to a fall hazard of approximately 18 to 26 feet.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  This condition exposed employees to the hazard of falling from an elevation of up to approximately 26 feet.
